This legal information sets out the terms governing the use of the BML Accounting & Tax website and the professional services provided by BML Accounting & Tax ("we", "our", or "us"). By using our website or engaging our services, you agree to these terms.

1 Professional Services

We provide professional accounting, taxation and related services including, but not limited to:

  • Bookkeeping
  • Annual Financial Statements
  • Independent Compilation Engagements (where applicable)
  • Tax Returns
  • VAT Services
  • Payroll Services
  • Company Secretarial Services
  • SARS Registrations
  • Accounting and Tax Advisory Services

The exact scope of each engagement will be set out in a written quotation and/or engagement letter.

2 Client Responsibilities

Clients agree to:

  • Provide complete and accurate information.
  • Submit documentation within agreed timeframes.
  • Review completed work where approval is required.
  • Inform us of any material changes affecting accounting or taxation matters.
  • Pay invoices by the due date.

The client remains responsible for the accuracy of all information supplied.

3 Fees and Payment

Fees are charged in accordance with accepted quotations or engagement letters.

Unless otherwise agreed:

  • Monthly services: Invoiced monthly in advance.
  • Once-off services: May require a deposit before work commences.
  • Additional work: Outside the agreed scope may be billed separately after approval.

Invoices are payable by the due date shown on the invoice. Late payment may result in suspension of services until the account has been settled.

4 SARS Deadlines

We will make every reasonable effort to meet statutory deadlines.

However, timely submission depends on clients providing complete and accurate information before agreed deadlines.

Notice: BML Accounting & Tax accepts no responsibility for penalties or interest arising from late, incomplete or incorrect information supplied by the client.

5 Professional Standards

Services are performed in accordance with applicable South African legislation and relevant professional standards.

Where Annual Financial Statements are prepared under an Independent Compilation Engagement, they will be prepared in accordance with ISRS 4410 where applicable.

6 Confidentiality

All client information is treated as confidential except where disclosure is:

  • Required by law;
  • Required by a regulatory authority; or
  • Authorised by the client.

7 Electronic Communication

Email and other electronic communication are accepted methods of communication.

While reasonable precautions are taken, electronic communication carries inherent security risks beyond our control.

8 Intellectual Property

Unless otherwise agreed in writing, all website content, pricing calculators, templates, reports, checklists, working papers and other material created by BML Accounting & Tax remain our intellectual property.

No material may be copied, reproduced or redistributed without prior written permission.

9 Limitation of Liability

To the maximum extent permitted by law, BML Accounting & Tax shall not be liable for indirect or consequential losses, loss of profits, business interruption or penalties arising from inaccurate or incomplete information supplied by the client.

Our liability is limited to losses directly resulting from proven professional negligence.

10 Refund and Cancellation Policy

Because accounting and taxation services involve professional time and expertise, refunds are considered on a case-by-case basis.

Before Work Begins

If services are cancelled before any work has commenced, payments may be refunded, less any reasonable administration or payment processing costs where permitted by law.

After Work Has Commenced

Once professional work has started, fees become payable for work completed up to the cancellation date. Any remaining prepaid balance will be refunded where applicable after deducting fees for work already performed.

Monthly Services

Monthly bookkeeping, payroll and recurring services may be cancelled by giving 30 days' written notice unless otherwise agreed.

Once-off Services

Services such as Annual Financial Statements, Tax Returns, VAT Registrations, Company Registrations and SARS applications are generally non-refundable once substantive work has commenced.

Approved refunds will normally be processed within 7–14 business days using the original payment method where possible.
